These terms will be applied fully and affect your use of TikiHosting.com. By using tikihosting.com (hereinafter referred to as "Website" or "Services"), you have agreed to accept all terms and conditions written here.

Entire Agreement

1. Service Level Agreement (SLA):

We guarantee 99.9% uptime for all of our hosting services. If we fail to meet this uptime guarantee, we will provide a credit to your account equal to 10% of your monthly hosting fee for each hour of downtime. Our support team is available 24/7 to assist with any issues you may have.


2. Fees and Payment:

The fee for our hosting services will be listed under plans. This fee includes storage and bandwidth as stated through those package plans. Any additional resources used beyond these limits will be charged separately. We accept payment by credit card or PayPal. Payment is due on the first of each month, and a late fee of $20 will be applied to any unpaid balances after the 10th of the month.


3. Use of Services:

You may use our hosting services for any lawful purpose. However, you are not permitted to use our services to engage in any illegal activity, including but not limited to distributing copyrighted material, spamming, or hosting phishing websites.


4. Termination:

We reserve the right to terminate your hosting services at any time for any reason, including but not limited to non-payment or violation of our acceptable use policy. If we terminate your account for non-payment, you will be responsible for any unpaid fees and a termination fee of $50. If we terminate your account for a violation of our acceptable use policy, you will not be entitled to a refund of any fees paid.


5. Data Backup and Restoration:

We perform daily backups of all customer data, and we store these backups for a period of 30 days. In the event of data loss, we will make every effort to restore your data from the most recent backup. However, we are not responsible for any data loss that may occur. It is the customer's responsibility to maintain their own backups of any critical data.


6. Security:

We maintain industry-standard security measures to protect the confidentiality and integrity of our customer data. However, it is the customer's responsibility to maintain the security of their account, including keeping their login credentials secure and protecting their data from unauthorized access.


7. Limitation of Liability:

We are not responsible for any damages or losses that may result from the use of our hosting services. This includes, but is not limited to, damages resulting from data loss, downtime, or security breaches.


8. Changes to Terms of Service:

We reserve the right to make changes to these terms of service at any time. Any changes will be effective immediately upon posting to our website.


9. Governing Law:

These terms of service will be governed by the laws of the province of Quebec and the federal laws of Canada. Any disputes arising from these terms of service will be resolved in the courts of the province of Quebec, with jurisdiction in the city of Montreal.


10. Dispute Resolution:

Any disputes arising between the customer and the hosting company will be resolved through mediation. If mediation is unsuccessful, the dispute will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
